1. Acceptance of Terms

Welcome to SnapCut (the "Service"), operated by Bravo Ciencia y Tecnología SpA ("we," "us," or "our"). By accessing or using the Service, you ("you" or "user") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the Terms, do not use the Service.

2. Description of the Service

Our Service allows users to upload images to remove or edit backgrounds. You retain all rights to your images; we only temporarily store and process your images to provide the background removal functionality.

3. Temporary Storage of Images

• Limited Retention: Images uploaded to SnapCut are stored on our servers only for the duration necessary to process and deliver the output to you.
• Automatic Deletion: After processing or a short window of time (e.g., 24 hours), your images are automatically deleted from our servers.
• No Backup Copies: We do not create or retain backup copies of user images beyond what is necessary for the normal functioning of the Service.

4. User Responsibilities

• Content Ownership: You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to upload any images.
• Prohibited Content: You agree not to upload any images that:

• Violate any applicable local, state, national, or international law or regulation.
• Contain explicit, abusive, defamatory, harassing, or otherwise objectionable material.
• Infringe or misappropriate any intellectual property rights, privacy rights, or proprietary rights of any party.

5. User-Provided Content

• License to Process: By uploading images, you grant us a limited, non-exclusive, worldwide license to process and manipulate your images solely as needed to provide the Service. We do not claim any ownership over your images.
• No Endorsement: We do not endorse or guarantee the accuracy, reliability, or legality of any user-provided images.

6. Intellectual Property Rights

• Our Content: All content and materials on the Service (excluding user images), including but not limited to text, graphics, logos, icons, images, software, and functionality, are owned or licensed by Bravo Ciencia y Tecnología SpA and are protected by intellectual property laws.
• Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for its intended purposes. You may not reproduce, distribute, modify, or create derivative works from our proprietary content without our express written permission.

7. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and safeguard your information. Please review our Privacy Policy to understand our practices.

8. Disclaimer of Warranties

• Service Provided "As Is": The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
• No Guarantee of Error-Free Operation: We do not warrant that the Service will be uninterrupted, secure, or error-free.
• No Liability for Images: We are not responsible for any images you upload that are lost, altered, or compromised, except to the extent required by applicable law.

9. Limitation of Liability

To the fullest extent permitted by law, Bravo Ciencia y Tecnología SpA shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Service.

10. Indemnification

You agree to defend, indemnify, and hold harmless Bravo Ciencia y Tecnología SpA and its officers, directors, employees, and agents from and against all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service;
• Your breach of any of these Terms;
• Any infringement or misappropriation by you of any intellectual property or other right of any person or entity.

11. Termination

• Right to Terminate: We reserve the right to suspend or terminate your access to the Service at any time, with or without cause.
• Effect of Termination: Upon termination, all rights granted to you under these Terms will immediately cease, and any images in our system will be removed in accordance with our storage practices.

12. Modifications to the Service and Terms

• Changes to Terms: We reserve the right to modify or update these Terms at any time. We will notify users of any material changes by posting the revised Terms on the Service or by other appropriate means.
• Continued Use: Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Chile, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Chile.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bravo Ciencia y Tecnología SpA regarding your use of the Service and supersede any prior agreements.
